1. Acceptance of Terms

By downloading, installing, or using Famsies ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Famsies. These Terms constitute a legally binding agreement between you and Famsies ("we," "us," or "our").

2. Description of Service

Famsies is a parenting support platform that includes an AI parenting coach (Sage), daily check-ins, a reflection journal, a co-parent messaging space, and a parent community (The Village). Famsies is available on iOS and Android.

3. Eligibility

You must be at least 18 years old to use Famsies. By using the App, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

4. Not a Medical or Therapeutic Service

Sage is an AI parenting coach, not a licensed therapist, psychologist, counselor, or medical professional. Nothing in Famsies constitutes professional mental health, medical, legal, or financial advice. The guidance provided by Sage is for informational and supportive purposes only and should not replace professional consultation.

5. Account Registration

You must create an account to use Famsies. You agree to:

  • Provide accurate and complete information
  • Keep your password confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

6. Subscriptions and Billing

Free tier: Famsies offers a free tier with limited features including 5 Sage conversations per month and 1 Repair Kit session per month.

Paid subscriptions: Premium features are available through monthly, annual, and family subscription plans processed through the Apple App Store or Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. You can manage or cancel your subscription in your App Store or Google Play account settings.

Prices may change with reasonable notice. Refunds are subject to Apple App Store and Google Play refund policies — we do not process refunds directly.

Family plan: The Family plan covers two linked co-parent accounts. Both accounts must be connected through the Co-parent feature to access shared benefits.

7. Acceptable Use

You agree not to:

  • Use Famsies for any unlawful purpose
  • Post harmful, abusive, hateful, or harassing content in The Village
  • Impersonate another person or entity
  • Attempt to access another user's account or data
  • Reverse engineer, decompile, or modify the App
  • Use Famsies to scrape, harvest, or collect data about other users
  • Interfere with or disrupt the App's infrastructure

8. Community Guidelines

The Village is a space for parents to support each other. We expect all users to:

  • Be respectful and kind
  • Not share content that is offensive, harmful, or inappropriate
  • Not share personal information of others without consent
  • Not promote products, services, or external platforms without permission

We reserve the right to remove content or suspend accounts that violate these guidelines without notice.

9. Co-Parent Features

By linking with a co-parent, you consent to:

  • Sharing your connection status with that person
  • That person viewing messages sent in the Co-parent Space
  • Sage potentially reading Co-parent messages when Sage is enabled

You may unlink from a co-parent at any time in Settings. Upon unlinking, neither party retains access to the shared space.

10. Intellectual Property

All content, branding, design, code, and technology in Famsies is owned by or licensed to Famsies and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

You retain ownership of content you create in Famsies — journal entries, community posts, and check-in responses. By posting in The Village, you grant Famsies a non-exclusive, royalty-free license to display that content within the app.

11. Disclaimer of Warranties

Famsies is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, Famsies and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or goodwill, arising from your use of the App — even if advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of Famsies shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Famsies and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of Famsies shall be resolved through binding individual arbitration under the rules of the American Arbitration Association, rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration. This arbitration clause does not apply to claims for injunctive relief or intellectual property disputes.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the courts of Orange County, Florida.

16. Changes to Terms

We may update these Terms periodically. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of Famsies after changes constitute acceptance of the updated Terms.

17. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from Settings. Upon termination, your right to use Famsies ceases immediately.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
